Agreement to these Terms

These Terms of Service (“Terms”) form a binding agreement between you and RefriForge concerning your access to and use of refriforge.com, the online store, customer-account features, content, products, and related services (collectively, the “Services”).

By accessing the Services, creating an account, submitting an order, or otherwise using the website, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services or place an order.

Our store is hosted by Shopify, which provides the commerce platform used to offer products and Services to you.

Eligibility and authority

You must be at least 18 years old and legally capable of entering a binding contract to use the Services or place an order. If you act for a company, employer, facility, or other organization, you represent that you have authority to bind that organization to these Terms.

You may use the Services only from and for delivery within the United States. You are responsible for determining whether your purchase, receipt, possession, transportation, storage, handling, resale, installation, recovery, and use of any product are lawful in your jurisdiction and circumstances.

Accounts and customer information

You agree to provide complete, current, and accurate information for your account, order, payment, delivery, certification, and support requests. You must promptly update information when it changes.

You are responsible for safeguarding account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized access or use.

We may request additional information to verify identity, payment authorization, delivery details, business authority, technician certification, purchasing eligibility, or fraud risk. Failure to provide satisfactory verification may result in an order hold, rejection, or cancellation.

Products, information, and availability

We make reasonable efforts to display product descriptions, cylinder weights, photographs, specifications, colors, prices, and availability accurately. Screen settings, packaging changes, manufacturer or supplier updates, and technical limitations can affect presentation.

Product information is provided for general identification and ordering purposes. It does not replace the equipment manufacturer’s documentation, safety data sheet, product labels, regulations, technical training, or professional judgment.

Products and quantities may be limited. We may modify or discontinue products, correct errors, or limit quantities at any time. A product listing is an invitation to submit an order and is not a guarantee of availability or acceptance.

Orders, pricing, and payment

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not mean the order has been accepted. We may accept, reject, hold, limit, or cancel an order for reasons including product availability, pricing or description errors, payment authorization, suspected fraud, shipping restrictions, certification requirements, legal compliance, or safety concerns.

Prices are displayed in U.S. dollars unless stated otherwise. Applicable taxes, fees, and any paid shipping services are calculated or disclosed during checkout. You authorize RefriForge and its payment providers to charge the selected payment method for the order total.

If a material pricing or product-information error affects an order, we may contact you for instructions or cancel and refund the affected amount. We do not intentionally charge a corrected higher price without your authorization.

We may limit or cancel orders that appear to be placed by dealers, resellers, distributors, or other parties when additional authorization, documentation, or terms are required.

Safe and lawful product use

Refrigerants must be selected, transported, stored, handled, recovered, installed, and disposed of by qualified persons using appropriate equipment and procedures. You agree to comply with all product labels, safety data, equipment-manufacturer instructions, EPA rules, Department of Transportation requirements, workplace rules, environmental laws, fire codes, and other applicable requirements.

• Verify the exact refrigerant specified for the equipment before ordering or use.
• Never mix refrigerant types or introduce an incompatible refrigerant into equipment.
• Do not intentionally release or vent refrigerant in violation of law.
• Do not alter, refill, puncture, abuse, or defeat the protective features of a disposable cylinder.
• Do not use a product for an unlawful, unsafe, unapproved, or mislabeled purpose.

You are solely responsible for job-site assessment, equipment compatibility, technician qualifications, and lawful product use after delivery, except to the extent responsibility cannot legally be excluded.

Shipping and delivery

RefriForge currently ships only within the United States. Standard shipping is free, and delivery is typically estimated at 2–5 business days. Estimates are not guarantees and may be affected by order verification, product availability, carrier capacity, weather, holidays, hazardous-material rules, remote destinations, incorrect addresses, or events outside our reasonable control.

You are responsible for providing a complete, accurate, and serviceable delivery address and for ensuring that an authorized recipient can lawfully receive the shipment. Carrier restrictions may prevent delivery to certain addresses or locations.

Tracking information is provided when available. If a shipment is delayed, missing, damaged, or delivered incorrectly, contact support@refriforge.com promptly with the order number and supporting details. Risk of loss and remedies for delivery issues are determined by applicable law, carrier terms, and our published policies.

Returns, refunds, and cancellations

Eligible return requests must be submitted within 14 days after delivery. Refrigerant cylinders must remain unused, unopened, unpunctured, factory-sealed, and in original condition and packaging. Written return authorization is required before any product is shipped back.

Refrigerant returns can be subject to hazardous-material transportation requirements. Do not mail or independently ship a cylinder. Follow only the return method authorized in writing by RefriForge.

Returns, refund processing, change-of-mind return-shipping costs, damaged or incorrect orders, and cancellation requests are governed by our Return & Refund Policy, which is incorporated into these Terms.

Intellectual property

The Services and their content—including the RefriForge name, logos, graphics, layout, product presentation, text, photographs, icons, code, and design elements—are owned by or licensed to RefriForge and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal or internal business purchasing purposes. You may not copy, reproduce, republish, distribute, scrape, modify, create derivative works from, sell, license, or commercially exploit protected content without written permission or a legal right to do so.

Prohibited conduct

You may not use the Services to:

• Violate a law, regulation, court order, carrier rule, certification requirement, or third-party right.
• Purchase, divert, resell, ship, export, receive, handle, or use refrigerants unlawfully.
• Provide false identity, payment, address, business, employment, resale, or certification information.
• Interfere with website security, introduce malicious code, probe systems, bypass controls, scrape data, or disrupt the Services.
• Use automated systems to place abusive orders, obtain unauthorized access, or copy store content.
• Commit fraud, impersonate another person, infringe intellectual property, harass others, or submit unlawful or deceptive content.

We may suspend access, cancel affected orders, preserve evidence, or report suspected unlawful conduct when reasonably necessary.

Third-party services and links

The Services may rely on or link to Shopify, payment providers, carriers, tracking websites, applications, analytics providers, and other third parties. Their products, services, availability, content, privacy practices, and terms are controlled by those third parties.

RefriForge is not responsible for third-party services except to the extent required by applicable law. Review the applicable third-party terms before using their services.

Privacy

Our collection, use, disclosure, and protection of personal information are described in the Privacy Policy. By using the Services, you acknowledge that personal information may be processed by RefriForge, Shopify, payment providers, carriers, and other service providers as described there.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

PRODUCT INFORMATION ON THE WEBSITE IS NOT INSTALLATION, ENGINEERING, SAFETY, ENVIRONMENTAL, REGULATORY, OR LEGAL ADVICE. YOU MUST RELY ON QUALIFIED PROFESSIONALS, PRODUCT LABELS, SAFETY DATA, EQUIPMENT DOCUMENTATION, AND APPLICABLE RULES.

Any product warranty expressly stated on a product page or supplied with a product is governed by its stated terms. Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, REFRIFORGE AND ITS OWNERS, PERSONNEL, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, USE, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM IMPROPER SELECTION, STORAGE, HANDLING, INSTALLATION, MIXING, VENTING, TRANSPORTATION, OR USE OF A PRODUCT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM A PRODUCT ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TO REFRIFORGE FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other non-waivable obligations.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RefriForge and its owners, personnel, affiliates, and service providers from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Services; breach of these Terms; false certification or purchasing information; infringement of another party’s rights; or unlawful, unsafe, or unauthorized transportation, handling, resale, installation, or use of a product.

This section does not require indemnification for conduct for which RefriForge is legally responsible and which cannot lawfully be shifted to you.

Governing law and disputes

These Terms and disputes relating to the Services or an order are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules, except where mandatory law provides otherwise.

Before filing a claim, you and RefriForge agree to make a good-faith effort to resolve the matter by written notice and direct communication. Send a description of the dispute, relevant order number, requested resolution, and supporting information to support@refriforge.com.

If a dispute cannot be resolved informally, it may be brought in a court of competent jurisdiction as permitted by applicable law. These Terms do not require individual arbitration and do not waive any right that cannot lawfully be waived.

General terms

These Terms and the policies incorporated by reference constitute the entire agreement concerning the Services and orders, except for additional written terms that expressly apply to a particular product, transaction, or program.

• Severability: If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue.
• No waiver: Failure to enforce a provision is not a waiver of the right to enforce it later.
• Assignment: You may not transfer your rights or obligations without our written consent. We may transfer ours in connection with a lawful business transaction or service arrangement.
• Electronic communications: You consent to receive order, account, policy, and transaction communications electronically when permitted by law.
• Headings: Section headings are provided for convenience and do not change the meaning of these Terms.

Changes to the Services or Terms

We may update the Services and these Terms to reflect operational, product, legal, regulatory, security, or business changes. The revised Terms will be posted with an updated “Last updated” date.

Changes apply prospectively from the effective date unless law requires otherwise. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms. Material changes may receive additional notice where required.
